Court Overturns Injunction on Abortion Law

CBNNews.com -- Abortion clinics in South Dakota will, for now, still be required to tell pregnant mothers getting an abortion will "terminate the life of a whole, separate, unique, living human being."
"We think it's a big victory for the woman obviously to be given accurate information in order to make a decision not only for the child, but also for herself," Harold Cassidy, a lawyer representing two pregnancy counseling centers said.
Planned Parenthood tried to get an injunction against South Dakota's informed consent law saying it puts a burden on physicians and a woman's right to choose an abortion, but a federal appeals court disagreed.
"The bottom line is if the state Legislature orders a professional to tell the truth, that's not a violation of the First Amendment," said South Dakota Attorney General Larry Long, who is defending the law in court.
South Dakota also requires abortion clinics to give pregnant mothers the opportunity to see an ultrasound of their unborn baby.
