Justice Stevens May Retire Too

Even though all the talk has been about a Rehnquist resignation, I’m getting word from some pretty reliable sources on Capitol Hill that John Paul Stevens may retire this summer as well. If that’s the case, then hold on everybody. If we thought the fight over O’Connor and Rehnquist would be brutal, the fight over Stevens is taking it to a whole new level. Stevens is part of a 6 vote block on the court that is in favor of upholding Roe V. Wade. If he resigns, plus O’Connor, that tips the scales in favor of a 5-4 decision to overturn Roe V. Wade if... and this is a big if, President Bush appoints 3 hard line conservatives. Having said that, one of my sources tells me that Stevens had two clerk interviews this past Tuesday for the 2006 Term – suggesting no intention to resign.
