A Virginia judge has scheduled John Allen Muhammad to be executed on Nov. 10.
Initially the attorney general's office called for a Nov. 9 execution. However the judge delayed it by one day, reasoning that it was better for government offices to open a day before in case there should be a last minute court action.
Muhammad received the death penalty for the murder of Dean Meyers. Myers was one of 10 slain during the Washington, D.C. 2002 shooting spree.
Muhammad's attorney, John Sheldon, has said he will file an appeal with the U.S. Supreme Court and ask the governor for clemency.
