The Department of Justice is calling for a Boston judge to dismiss a lawsuit claiming the Defense of Marriage Act is unconstitutional.
DOMA is a federal law defining marriage as between a man and a woman. The lawsuit in Boston claims DOMA is unconstitutional.
Now the Justice Department is asking for the lawsuit to be dropped. They say the Obama administration agrees that DOMA discriminates and should be repealed.
But the Justice Department says DOMA is "constitutionally permissible" and therefore wants the lawsuit dropped.
