Jury selection begins January 5 for the accused Boston marathon bomber, Dzokar Tsarnaev.

At a pre-trial hearing on Thursday, the judge said he will rule in writing whether Tsarnaev can be tried away from Boston as his lawyers requested.

The real drama happened outside the courtroom: a testy exchange took place between a man who lost his leg in the bombing and protestors supporting Tsarnaev, who question whether there's any proof against him.

Marc Fucarile held up his prosthetic leg and said, "That's the proof."

One of the demonstrators then said, "You should care that they get the right guy."

To which Fucarile replied, "Get a life, lady. Go to work."

Tsarnaev has not been seen in public since his last court appearance a year and a half ago. He and his brother Tamerlan Tsarnaev are accused of detonating homemade bombs near the finish line of the Boston marathon on April 15, 2013.

The explosion killed three people and injured more than 260. Tamerlan was killed in a shootout with police days after the bombing.
