A Kentucky pastor is calling a ruling forcing the commonwealth to recognize gay marriages from other states unconstitutional.

The decision by federal Judge John Heyburn means married gay couples can now have the same benefits of traditionally married couples in Kentucky.

But retired Pastor Bob Russell said the government is trampling the rights of Kentucky voters and people with religious convictions against gay marriage.

"I think the people of Kentucky have spoken by their vote and I hate to see the government step in and just override the voice of the people," Russell said. "I think we see religious freedom infringed on again and again and this ruling limits people who have convictions about this issue to take a stand against it."

In 2004, voters passed a constitutional amendment defining marriage as between a man and a woman.

Kentucky's attorney general has asked for a stay on the ruling pending an appeal.
