How would you feel if you bought property with a government loan, only to have a different federal agency take it away? It happened to one Texas rancher and now Uncle Sam's looking to do it again. Read Transcript

Reporter: THE MARCH

DUST-UP BETWEEN CLIVE BUN

DEAND TH BUNDY AND THE

BUREAU OF LAND RAISED EYE

BROWSES AMONGST MANY

AMERICANS WHO FEEL THE

FEDERAL GOVERNMENT EXERCISES

TOO MUCH CONTROL.

IN TEXAS, ANOTHER FIGHT HAS

BEEN RAGING BETWEEN RANCHERS

AND THE B.L.M.

THERE HAS BEEN SOME DISPUTE

OVER THE BOUNDARY LINE.

YEARS AGO, THEY DECIDED IT

WAS THE VEGETATION LINE ON

THE SOUTH SIDE.

AS THE RIVER HAS MOVED OVER

TIME, IT HAS CAUSED A

PROBLEM.

BECAUSE OKLAHOMA SAYS

WHENEVER THE RIVER MOVES

SOUTH, OKLAHOMA PICKS UP

MORE LAND.

BUT WHEN IT MOVES BACK

NORTH, THE PROPERTY BOUNDARY

STAYS WHERE IT IS.

OBVIOUSLY, TEXAS DISAGREES,

ESPECIALLY THE RANCHERS WHO

OWN LAND ALONG THE BORDER.

B.L.M. HAS DEFINITELY HAD

A CHANGE OF PERSONALITY IN

THE LAST 30 YEARS.

Reporter: TOMMY'S

FAMILY HAS RAISED COTTON AND

CATTLE ALONG THE RED RIVER

FOR OVER 100 YEARS.

HE BOUGHT HIS LAND FROM HIS

AUNT 30 YEARS AGO, AND DID

SO WITH A LOAN FROM THE

FEDERAL HOUSING

ADMINISTRATION.

THEY BLESSED THE

PROPERTY.

THEY INSPECTED THE

PROPERTY.

A DIFFERENT GOVERNMENT AGENT

SEE INSPECTED THE PROPERTY,

SAID IT WAS FINE, THE DEED

WAS GOOD, AND THE TITLE WAS

GOOD.

BUT THEN JUST FIVE YEARS

LATER, I LOST IT IN A COURT

OF LAW, AND I STILL HAD TO

PAY FOR THE PROPERTY.

I STILL HAD TO PAY BACK THE

LENDING INSTITUTION, BECAUSE

IF I DIDN'T, THEY WOULD COME

AND GET EVERYTHING ELSE.

Reporter: USING

OKLAHOMA'S SELF-SERVING

DEFINITIONS OF EROSION, THE

U.S. FEDERAL GOVERNMENT

DECIDED HENDERSON NEVER

ACTUALLY OWNED 140 ACRES

BORDERING THE RIVER.

THIS CENTUR IS THE

BOUNDARY MARKER BETWEEN

TEXAS AND OKLAHOMA.

THE RED RIVER IS A MILE AND

A QUARTER TO THE NORTH OF

US.

THEY TOOK A LITTLE OVER A

THIRD OF THIS PROPERTY.

Reporter: ON TOP OF

THAT, HE HAD TO CONTINUE

PAYING THE MORTGAGE.

AS A MATTER OF FACT, I

JUST FINISHED MAKING MY LAST

PAYMENT ON IT, ON THIS FARM,

IN JANUARY OF THIS YEAR.

Reporter: THE BUREAU OF

LAND MANAGEMENT ASSERTS ON

ITS WEBSITE THE B.L.M. IS

CATEGORICALLY NOT EXPANDING

FEDERAL HOLDINGS ALONG THE

RED RIVER.

WHAT IT IS DOING IS

REVISITING THE HENDERSON

RULING AND CALLING FOR NEW

BOUNDARIES OF PUBLIC LANDS

ALONG THE RIVER.

THE RESULT COULD GIVE THE

FEDS BACK CONTROL OF UP TO

90,000 ACRES OF PRIVATE

LAND.

IT IS CLEARLY A LAND

GRAB.

WE DON'T UNDERSTAND WHY THE

B.L.M. IS ENGAGED IN TRYING

TO TAKE THIS PROPERTY AWAY.

Reporter: GENE HALL

SAYS THE BORDER EXPIEWT

DISPUTE WITH OKLAHOMA ISN'T

THE WORSE PROBLEM.

THIS IS PART OF A

DISTURBING PATTERN.

THE FEDERAL GOVERNMENT SEEMS

TO WANT TO TAKE CONTROL OF

EVERY MUD HOLE IN AMERICA,

EVERY DITCH NEAR AN

AGRICULTURAL FIELD, STANDING

WATER, EVEN LAND THAT IS NOT

EVEN WET MOST OF THE TIME.

Reporter: THE CLEAN

WATER ACT COVERS THE WATERS

OF THE UNITED STATES.

A 2006 SUPREME COURT RULING

SET THE DE DEFINITION AT

PERMANENT STREAMS, LAKES,

AND AREASç THAT DIRECTLY

EFFECT PERMANENT WATERS.

NOW THE E.P.A. IS MODIFYING

THAT DEFINITION TO INCLUDE

NEARLY ANYTHING THAT IS OR

GETSç WET.

THE PERMITING OF THAT

WILL GET EXTREMELY

EXPENSIVE.

WE THINK THEY ARE OUT TO

REGULATE EVERY FOOT OF

GROUND IN AMERICA THAT WATER

EVEN TOUCHES AT VARIOUS

TIMES.

NO ONE IS INTERESTED IN

FOULING THE WATER AND THE

AIR AND THE LAND WHERE THEY

LIVE.

BEAR IN MIND, THEY LIVE OUT

THERE.

THEY DRINK THE WATER FROM

WELLS IN MOST CASES.

FARMERS AND RANCHERS ARE NOT

THE PROBLEM WHEN IT COMES TO

CLEAN WATER AND SHOULDN'T

HAVE TO CARRY THE BURDEN.

Reporter: SID RAISES

HORSES IN STEVENVILLE,

TEXAS, AND NOW HE IS RUNNING

FOR STATE AGRICULTURAL

COMMISSIONER.

I'M A STEWART OF THE

LAND.

IF I DON'T TAKE CARE OF THE

LAND, IT DOESN'T TAKE CARE

OF MY FAMILY.

I'M VERY CONSCIOUS ABOUT

THIS.

THE SUPREME COURT SAID THE

E.P.A. HAS JURISDICTION OVER

WATERS AND RIVERS AND LAKES,

AND STREAMS AND OCEANS.

THEY ARE AVERTING CONGRESS,

AND THE SUPREME COURT, AND

THE CONTUSION.

AN CON -- CONSTITUTION.

THEY ARE TRYING TO CHANGE

THAT.

IT COULD BE A DRY DITCH IN

AURORA OR A COW TRAIL OR

ANYTHING.

Reporter: AND MILLER

CLAIMS THE GOVERNMENT

THREATENS TEXAS FARMERS MORE

THAN THE RECORD-BREAKING

DROUGHT.

THE LATEST THREAT IS NOT

THE DROUGHT OR HIGH FEED

PRICES OR HIGH FERTILIZER

PRICES.

IT IS THE OVERREACHING OF

THE LAND.

45% OF THE LAND IS OWNED BY

THE FEDERAL GOVERNMENT.

IF YOU WANT TO STIMULATE THE

ECONOMY AND GET THIS COUNTRY

GROWING, PUT THAT IN THE

HANDS OF THE PRIVATE

INDIVIDUALS.

WE'LL MAKE IT PROFITABLE.

Reporter: FROM THE RED

RIVER VALLEYS, I'M CHUCK

HOLTON FROM CBN NEWS.
