GOP Hopeful Ted Cruz Facing First 'Birther' Lawsuit

Sen. Ted Cruz, R-Texas, is facing his first lawsuit questioning his eligibility to serve as president of the United States.

The case was filed Thursday by Texas lawyer Newton Schwartz.

"The U.S. Constitution is not a popularity document for fair weather only," the lawsuit says.

"However persuasive one finds each side in this debate, the final decision ultimately rests in the hands of five or more of nine justices on the Supreme Court as mandated by the Constitution," it said.

The lawsuit comes after a series of attacks from GOP rival Donald Trump regarding Cruz's status.

The Texas lawmaker, meanwhile, is standing his ground.

"The facts and the law here are really quite clear," he told Trump during Thursday night's GOP debate in South Carolina. "Under longstanding U.S. law, the child of a U.S. citizen born abroad is a natural-born citizen."
