The Maine Supreme Court ruled on August 30 that Marilyn Kirby and Ann Courtney, could jointly adopt seven-year-old Steve and 10-year-old Michelle. The lesbian couple have cared for the two children since 2001.
"We just kept our heads up and said 'no matter how long it takes, we're going to take this all the way to the Maine Supreme Court if necessary,' and that's what we did," said Courtney, who claimed the case was primarily about legal protection for the children.
The decision overrode a probate court's rejection of the couple's plea to receive a petition for adoption.
Unmarried heterosexual couples would also be able to adopt under the ruling.
"This opens the probate courts to people who are raising children, but are not married," said the civil rights project director for the Gay & Lesbian Advocates and Defenders, Mary Bonauto.
Bonauto further stated that the decision works in the children's best interest. However, nothing was said about the concerns some groups have raised about the increased risks that children can face living in homosexual environments. Those concerns include higher rates of promiscuity, sexually transmitted diseases and depression.
"Not only is this not the situation, but also there is sound evidence that children exposed to the homosexual lifestyle may be at increased risk for emotional, mental, and even physical harm," the American College of Pediatricians states in an article published on their Web site, called Parenting Issues.
The ACP further states that studies favoring same-sex parent adoption are "criticallly flawed" because the sample sizes are too small to make such broad conclusions. The studies also have no proper controls in place and are based on biased selections.
The Fight for American Values
The increasing judicial support of alternative lifeslyles in America has been regarded by many Christian groups as attempting to undermine the Judeo-Christian values in which the nation has been built.
Alliance Defense Fund, American Center for Law and Justice and Liberty Counsel are Christian legal organizations that have worked to protect traditional values and rights for Americans in the courtroom.
